Donald Trump has asked the U.S. Supreme Court to reinstate his “reciprocal tariffs” policy after lower courts ruled that he exceeded his authority by using the 1977 International Emergency Economic Powers Act (IEEPA). The Court of Appeals determined that Congress did not grant presidents unlimited power to impose tariffs and rejected Trump’s use of emergency powers. Trump called this decision “highly partisan” and warned that it could “destroy the United States.” His administration is urging the Supreme Court to take up the case quickly, claiming that the tariffs are crucial for economic security.
Trump first announced the tariffs in April, setting a baseline rate of 10 per cent on imports and higher rates on key trading partners such as China and Canada. The announcement caused global markets to react, prompting him to delay their implementation while negotiating limited deals with countries like the U.K. and Vietnam. A revised list released in August included heavy tariffs on India, Switzerland, and others. In response, small businesses and 12 states filed a lawsuit, leading the appeals court to rule 7–4 that IEEPA does not authorise presidents to impose tariffs. Business groups welcomed this decision, arguing that the tariffs were unlawful and harmful.
