The International Criminal Court’s chief prosecutor, Karim Khan, is seeking arrest warrants for three top Hamas leaders—Ismail Haniyeh, Yahya Sinwar, and Mohammed Diab al-Masri (also known as Deif)—as well as Israeli Prime Minister Benjamin Netanyahu and Defense Minister Yoav Gallant. The warrants are for war crimes and crimes against humanity committed in Israel and Gaza. Khan’s accusations against Hamas leaders include extermination, murder, taking hostages, rape, torture, and other inhumane acts, alleging they are responsible for the killing of hundreds of Israeli civilians in the October 7 attacks. Evidence for these accusations includes CCTV footage, authenticated audio, photo and video material, and statements from Hamas members.
Meanwhile, Netanyahu and Gallant are accused of war crimes and crimes against humanity in the Gaza Strip, including the starvation of civilians, willful killing, and attacks against civilian populations. Khan’s office claims that Israel systematically deprived Gaza’s population of essential supplies, imposed a total siege, cut off water and electricity, and obstructed humanitarian aid. The aim, according to the prosecutor, was to eliminate Hamas, secure the return of hostages, and collectively punish Gaza’s civilian population. Israel, represented by Benny Gantz, criticized Khan’s announcement, defending its military operations and judicial system. The prosecutor must now request the warrants from a pre-trial panel of judges, who will review the evidence and decide on the proceedings.

So what
This is going to create an interesting situation in the international criminal courts. While it is unlikely that any of these people will actually appear in front of the courts, Israel will likely send its lawyers to argue their case. As for the leaders of Hamas, who are highly unlikely to appear before the courts, this possibly puts Qatar in a tough situation, as they support the group’s leadership.
