The leaked European Commission proposal outlines significant rollbacks to the EU’s landmark GDPR, aiming to reduce regulatory burdens on businesses and bolster global competitiveness. Key changes include narrowing the definition of personal data, allowing companies greater freedom to process user information, particularly for AI training, under the banner of “legitimate interest.” Cookie consent pop-ups would largely disappear, shifting responsibility to users to request data removal after the fact. Sensitive data protections under Article 9 would also shrink, with indirect data such as browsing behaviour losing many of its previous safeguards, though biometric and genetic data would remain highly protected. Additionally, the EU plans to delay major AI law provisions until 2027, a move supported by large corporations seeking more time to adapt.
These proposals have sparked strong criticism from privacy advocates, civil society organisations, and some of the original architects of GDPR, who argue the changes prioritise corporate interests and political pressures, particularly from the U.S., over citizens’ rights. Critics warn that the reforms would dismantle core digital protections, increase vulnerability to surveillance, and undermine fundamental rights. While the European Commission insists that privacy standards will not be lowered, passing the proposal will require approval from the European Parliament and member states, many of whom remain sceptical. The coming legislative battle is expected to determine whether Europe maintains its reputation as the global leader in digital rights or shifts toward a more industry-driven regulatory landscape.
